ST. THOMAS — V.I. Agriculture Commissioner Positive Nelson’s nomination to the Cannabis Advisory Board was held in committee Thursday, as lawmakers agreed that his role as a former senator in drafting the medical marijuana bill presented a legal gray area.

The issue, according to the Rules and Judiciary Committee, was one of legal interpretation; specifically, in regard to the Revised Organic Act of 1954, which prohibits senators from being appointed to any office that was created by the Legislature during their tenure, and from serving in that office within one year after their Senate term expires.
